General Booking Conditions for Package Travel
Last updated: 21 October 2026
These conditions apply to the golf holidays and other package travel that Golf Breaks Italy sells. Please read them together with your written proposal, the standard information form and your booking confirmation, which together form your contract. If your proposal or booking confirmation says something different from these conditions, the proposal or confirmation applies, as long as it does not reduce your rights under the law.
1. Who we are
Your package is organised by Hurray! Italia, trading as Golf Breaks Italy, Via Alfredo Fusco 35, 00136 Rome, Italy. VAT number IT-11602831007. Registered with the Rome Chamber of Commerce (C.C.I.A.A. di Roma), REA no. 1437081. Owner and legal representative: Jaana Merasvuo. Phone +39 339 3478576, email info@golfbreaksitaly.com.
Details of our insolvency protection and our civil liability insurance are stated in your proposal and in your booking confirmation.
2. Legal framework
Our packages are governed by the Italian Tourism Code (Legislative Decree 79/2011, Title VI, Chapter I, from Article 32, as amended by Legislative Decree 62/2018, which implements Directive (EU) 2015/2302 on package travel), by the Italian Civil Code and, where applicable, by the Italian Consumer Code (Legislative Decree 206/2005). Nothing in these conditions limits the rights these laws give you.
These conditions apply to travellers who book a package with us, whether individuals, families, friends travelling together or groups. Business travel booked under a general agreement for business travel between a company and us may be excluded from package travel law and covered by separate terms agreed in writing.
3. Your key rights under package travel law
Because you are buying a package, you have all the EU rights that apply to packages. Hurray! Italia is fully responsible for the proper performance of the package as a whole and has protection in place to refund your payments and, where transport is included, to ensure your return if it becomes insolvent. In summary:
- You receive all essential information about the package before signing the contract.
- At least one trader is always responsible for the proper performance of all travel services included in the contract.
- You are given an emergency telephone number or contact point to reach the organiser.
- You may transfer the package to another person, on reasonable notice and possibly against additional costs.
- The price may only be increased if specific costs rise (for example fuel prices) and this is expressly provided for in the contract, and in any case not later than 20 days before the start of the package. If the increase is more than 8% of the price, you may terminate the contract. If the contract reserves the right to increase the price, you are entitled to a price reduction if the relevant costs decrease.
- You may terminate the contract without paying a termination fee and get a full refund if any of the essential elements of the package, other than the price, is changed significantly. If the organiser cancels the package before it starts, you are entitled to a refund and, where appropriate, compensation.
- You may terminate the contract without paying a termination fee before the start of the package in the event of exceptional circumstances, for example serious security problems at the destination which are likely to affect the package.
- You may also terminate the contract at any time before the start of the package against an appropriate and justifiable termination fee.
- If, after the start of the package, significant elements of it cannot be provided as agreed, suitable alternative arrangements must be offered to you at no extra cost. You may terminate the contract without paying a termination fee where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
- You are entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
- The organiser has to provide assistance if you are in difficulty.
- If the organiser becomes insolvent, your payments will be refunded. If the organiser becomes insolvent after the start of the package and transport is included, your repatriation is secured.
Directive (EU) 2015/2302 is available on EUR-Lex; the Italian Tourism Code is available on normattiva.it.
4. Information before you book
Before you book, we send you a written proposal by email. It contains the information required by Article 34 of the Italian Tourism Code, including:
- the travel destination, itinerary and dates, with the number of nights;
- the accommodation, its location, category and meal plan;
- the golf courses, number of rounds and what is included (for example buggies, trolleys or range balls);
- any transfers, with their type and approximate times;
- other services, excursions or meals included;
- whether the services are suitable for persons with reduced mobility, on request;
- the total price including taxes and all fees and charges, and any costs that are not included, such as local tourist taxes paid at the hotel;
- the deposit, the date for the balance and the accepted payment methods;
- the minimum number of participants, if any, and the deadline by which we may cancel if it is not reached;
- general information about passport, visa and health requirements;
- the termination fees that apply if you cancel;
- information on optional travel insurance;
- the standard information form for package travel.
The information in the proposal forms part of your contract and cannot be changed unless we both agree, or as allowed by these conditions and the law. Any change will be communicated to you clearly before the contract is concluded.
5. How to book
- Enquiry: you send us a request through the form on our website or by email. An enquiry does not commit you to anything.
- Proposal: we send you a written proposal with the information above. Prices and availability are confirmed only when we confirm your booking, as hotels and golf courses release rooms and tee times on request.
- Acceptance: you accept the proposal in writing (for example by email) and pay the deposit stated in the proposal. The person who books (the "lead traveller") confirms that they are authorised to book on behalf of everyone named in the booking and accepts these conditions for all of them.
- Confirmation: the contract is concluded when we send you our booking confirmation by email or another durable medium. The confirmation sets out all the details of your package as required by Article 36 of the Italian Tourism Code.
- Travel documents: in good time before departure we send you the vouchers, tee times, transfer details, an emergency contact number and any other documents you need.
Please check the confirmation carefully and tell us at once if any detail, including names, is wrong.
6. Payments
- The deposit and the date by which the balance must be paid are stated in your proposal and booking confirmation.
- Payment is made by bank transfer or the other methods stated in your proposal. Please never send card details by email or through the forms on our website; if card payment is offered, we will give you a secure way to pay.
- For bookings made after the balance due date, the full price is due at booking.
- If the deposit or the balance is not paid by the due date, we will remind you in writing. If payment is still not made within the time stated in our reminder, we may treat the booking as cancelled by you, and the termination fee stated in your proposal and booking confirmation will apply.
- Some suppliers, such as self-catering apartments, may ask for a refundable security deposit on arrival. If so, this is stated in your proposal.
7. Price
The price of your package is the one in your booking confirmation. It includes the services listed there and nothing else. Local tourist or city taxes, extra rounds, buggies or other services not listed, drinks, tips and personal expenses are not included unless your confirmation says so.
Golf Breaks Club points and welcome discounts, where they apply, are applied as stated in your proposal and follow the Club rules shown on our Club page. They do not change your rights under these conditions.
Price changes after booking. We may increase the price after the contract is concluded only if your booking confirmation expressly allows it, and only as a direct result of changes in:
- the cost of passenger transport resulting from the cost of fuel or other power sources;
- taxes or fees on the travel services imposed by third parties not directly involved in performing the package, such as tourist taxes or landing and port fees;
- exchange rates relevant to the package.
We will tell you about any increase clearly and in writing, with a justification and the calculation, at least 20 days before the start of the package. If the increase exceeds 8% of the total price, you may accept it or terminate the contract without paying a termination fee (see section 9). Where the confirmation allows price increases, you are equally entitled to a reduction if those costs fall after the contract is concluded. From any refund we may deduct the administrative costs we actually incurred, which we will document on request.
8. Changes by us before departure
We may make minor changes to your package before departure if your booking confirmation reserves this right. We will inform you clearly and in writing. Examples are a change of tee time on the same day or a change of transfer company.
If we have to make a significant change to one of the main features of your package, cannot meet a special request we accepted, or need to raise the price by more than 8%, we will tell you without undue delay, clearly and in writing, explaining:
- the proposed change and its effect on the price;
- the reasonable period within which you must tell us your decision;
- what happens if you do not reply within that period;
- any substitute package offered and its price.
You may accept the change or terminate the contract without paying a termination fee. If you terminate, you may accept a substitute package of equivalent or higher quality if we offer one. If the change or substitute package is of lower quality or cost, you are entitled to an appropriate price reduction. If you terminate and do not accept a substitute, we will refund all payments made by you or on your behalf without undue delay and in any case no later than 14 days after termination. You may also be entitled to compensation as explained in section 12.
9. Cancellation by you before departure
At any time. You may terminate your contract at any time before the start of the package by telling us in writing. You will then have to pay the termination fee stated in your proposal and booking confirmation. These fees are reasonable standard amounts based on how long before departure you cancel and on the savings and income we expect from re-using the services. If no standard fee applies, the fee is the price of the package minus the cost savings and income from re-using the services, and we will justify it on request. We will refund any amount you have paid in excess of the fee without undue delay and in any case within 14 days.
Unavoidable and extraordinary circumstances. You may terminate without paying a termination fee if unavoidable and extraordinary circumstances occurring at the destination or its immediate vicinity significantly affect the performance of the package, or the transport of passengers to the destination included in the package. Examples are serious security risks, natural disasters or a serious health emergency at the destination. In this case you receive a full refund of the payments made within 14 days, but no additional compensation.
Contracts signed away from our premises. If a contract is negotiated and signed away from our business premises (for example at a golf fair or at your home or club), you may withdraw within 5 days of signing it, or of receiving the contract terms and pre-contract information if later, without paying a fee and without giving a reason. This right does not apply to offers at substantially reduced prices compared with current offers; in that case we will clearly tell you before you sign.
Bookings made at a distance. The 14-day right of withdrawal for contracts made online, by email or by phone does not apply to package travel contracts (Article 47 of the Italian Consumer Code). You can still cancel at any time as explained above.
Unused services. Services you do not use, for example rounds of golf you choose not to play, nights you leave early or a no-show, are not refunded, unless the supplier gives us a refund, which we will pass on to you.
10. Transfer of your booking to another person
You may transfer your package to another person who meets all the conditions for it (for example, a golfer for a golf package), by telling us in writing at least 7 days before the start of the package. You and the new traveller are jointly responsible for paying the balance and any additional fees, charges and costs caused by the transfer. We will tell you what these costs are; they will be reasonable, not more than the costs we actually incur, and we will give you proof of them. Some suppliers may not allow name changes, or may charge for them; we will tell you before you decide.
11. Cancellation by us before departure
We may cancel your package and give you a full refund, without additional compensation, only if:
- the number of people booked is lower than the minimum stated in your contract, and we tell you within the deadline stated there, which is no later than 20 days before the start for trips of more than 6 days, 7 days before for trips of 2 to 6 days, and 48 hours before for trips of less than 2 days; or
- we are prevented from performing the contract by unavoidable and extraordinary circumstances, and we tell you without undue delay before the start of the package.
We will refund all payments within 14 days of cancellation. If we cancel for any other reason, you are also entitled to compensation where appropriate.
12. During your trip: problems, complaints and our responsibility
Our responsibility. We are responsible for performing all the travel services included in your package, whether we provide them ourselves or through hotels, golf clubs, transfer companies or other suppliers.
Tell us at once. If something is not as agreed, please tell us without undue delay, taking into account the circumstances, using the emergency number in your travel documents or by email, and also tell the supplier's staff on the spot. Telling us promptly gives us the chance to fix the problem and may affect the amount of any price reduction or compensation.
Putting things right. We will remedy any lack of conformity, unless this is impossible or would cost a disproportionate amount given the extent of the problem and the value of the services affected. If we do not remedy it within a reasonable period you set, you may do so yourself and ask us to reimburse the necessary expenses. If a significant part of the services cannot be provided as agreed, we will offer suitable alternatives of equivalent or higher quality at no extra cost. If the alternatives are of lower quality, we will give you an appropriate price reduction. You may reject the alternatives only if they are not comparable to what was agreed or if the price reduction offered is inadequate.
Termination during the trip. If a lack of conformity substantially affects the package and we do not remedy it within a reasonable period, you may terminate the contract without paying a termination fee and ask for a price reduction and/or compensation. If the package includes transport, we will also arrange your return with equivalent transport at no extra cost.
If you cannot return as planned. If, because of unavoidable and extraordinary circumstances, your return transport included in the package cannot be provided as agreed, we will pay for necessary accommodation, if possible of equivalent category, for up to 3 nights per traveller, or longer where EU passenger rights rules provide for it. The 3-night limit does not apply to persons with reduced mobility and their companions, pregnant women, unaccompanied minors or persons in need of specific medical assistance, provided you told us of their needs at least 48 hours before the start of the package.
Assistance. If you are in difficulty, we will give you appropriate assistance without undue delay, including information on health services, local authorities and consular assistance, help with communications and help finding alternative travel arrangements. If the difficulty was caused intentionally or through negligence by you, we may charge a reasonable fee, not more than the costs we actually incur.
Price reduction and compensation. You are entitled to an appropriate price reduction for any period during which there was a lack of conformity, and to appropriate compensation for any damage you suffer as a result, unless we prove that the lack of conformity is attributable to you, to a third party unconnected with the services in the package that could not be foreseen or avoided, or to unavoidable and extraordinary circumstances. Where a serious failure to perform the services is not of minor importance, you may also claim compensation for the holiday time wasted and the loss of an opportunity that cannot be repeated (ruined holiday).
Limits. Where international conventions binding on the EU or Italy limit the compensation payable by a supplier, the same limits apply to us. Nothing in these conditions limits our liability where the law does not allow it.
Time limits for claims. Under Italian law, the right to a price reduction or compensation expires 2 years after your return; the right to compensation for personal injury and for a ruined holiday expires 3 years after your return, or after any longer period set by the rules applying to the services included in the package.
Written complaints. Please send any complaint after your trip in writing, as soon as possible, to info@golfbreaksitaly.com or Hurray! Italia, Via Alfredo Fusco 35, 00136 Rome, Italy, with your booking reference and any supporting documents. We will acknowledge it and reply in writing. We reply to complaints as quickly as possible. If you booked through a travel agent, you can also send messages and complaints to us through the agent.
13. Your responsibilities
- Give us correct and complete information, including the names of all travellers exactly as in their identity documents, and tell us about special needs before booking.
- Follow the rules of the hotels, apartments and golf clubs, and the instructions of our staff and suppliers.
- Arrive on time for tee times and transfers. Missed services caused by late arrival are not refunded.
- Pay for any damage you cause to accommodation, golf courses, buggies or other property.
14. Golf: what to know
- Handicap and certificates. Many Italian golf clubs require players to show a valid handicap certificate or membership card of a recognised golf federation, and some set a maximum handicap for certain courses or days. The requirements of each course are given in your proposal or travel documents. Please bring proof of your handicap. If a club refuses play because the required proof is missing or the handicap limit is not met, this is not a lack of conformity on our part.
- Tee times. Tee times are booked subject to availability at the course and are confirmed in your travel documents. Clubs may change tee times for competitions, maintenance or safety; we will tell you as soon as we know and look for the best alternative.
- Dress code and etiquette. Golf clubs apply dress codes (for example collared shirts, no denim, soft-spike golf shoes) and rules on pace of play, buggies and course care. Players who do not respect them may be refused play.
- Weather and course conditions. Golf is played outdoors. Rain, wind, heat, frost or course maintenance (for example hollow-tining or sanding of greens) may limit play, restrict buggies or close a course. Refunds or rain checks for rounds not played because of weather or course closures are given only according to the rules of the golf club, unless your booking confirmation says otherwise. If a course is closed for reasons that are a lack of conformity under section 12, your rights under section 12 apply.
- Green fees. Green fees included in your package are valid only for the courses, dates and number of rounds stated. Some clubs charge extra at weekends and on public holidays; any such supplement is stated in your proposal. Buggies, caddies, range balls and equipment hire are included only if listed.
- Golf equipment. Please check with your airline about carrying golf bags. Damage to or loss of golf equipment during flights is the airline's responsibility unless flights are part of your package.
15. Passports, visas and health
- Every traveller must carry a valid passport or, for citizens of the EU, EEA and Switzerland, a valid national identity card. Hotels in Italy are required by law to register guests' identity documents on arrival.
- Citizens of countries outside the EU should check entry requirements in good time with the Italian embassy or consulate or their own government, including any visa, the EU Entry/Exit System and, where applicable, the travel authorisation ETIAS. We give general information on request, but obtaining the right documents is your responsibility. Costs caused by missing or invalid documents are not refunded.
- EU residents should bring their European Health Insurance Card (EHIC). It does not replace travel insurance.
- Please tell us before booking about any medical condition or reduced mobility that may affect your trip, so we can tell you whether the package is suitable.
16. Insurance
As required by Italian law, we hold civil liability insurance covering our liability to travellers and protection against insolvency or bankruptcy that guarantees the refund of the payments you have made and, where transport is included, your return. If our insolvency affects your package, you can contact the guarantor directly.
These policies do not cover your personal risks. We strongly recommend that you take out travel insurance covering cancellation, medical expenses and repatriation, baggage and golf equipment, and personal liability on the golf course.
17. Personal data
We use your personal data to arrange and carry out your trip as explained in our Privacy Policy.
18. Disputes, governing law and courts
Talk to us first. Most problems can be solved quickly by contacting us directly.
Out-of-court dispute resolution. Hurray! Italia does not commit in advance to using a specific alternative dispute resolution body. If a complaint cannot be resolved between us, we will tell you in writing whether we will take part in an ADR procedure. The list of ADR bodies recognised in Italy is published by the Ministry of Enterprises and Made in Italy at mimit.gov.it. If you live in another EU country, the European Consumer Centre in your country or the European Consumer Centre Italy (ecc-netitalia.it) can help you free of charge, and claims up to €5,000 can be brought through the European Small Claims Procedure.
Governing law. Your contract is governed by Italian law. If you are a consumer living in another country, this does not deprive you of the protection given to you by the mandatory rules of the country where you live.
Courts. If you are a consumer, you may bring proceedings in the courts of the place where you live or in Italy, and we may bring proceedings against you only in the courts of the place where you live. For consumers resident in Italy, the court of the consumer's place of residence or domicile has jurisdiction. For customers who are not consumers, the courts of Rome have jurisdiction.
19. Language
These conditions are available in English. If there is any difference between language versions, the English version applies; this never reduces your rights as a consumer.
